Terms of Service
This Terms of Service Agreement governs your use of the MyEchoPath mobile application, website at myechopath.com, and related services operated by MyEchoPath LLC. By accessing or using the Service in any way, you agree to be bound by these Terms.
No Medical Advice: MYECHOPATH DOES NOT PRACTICE MEDICINE OR PROVIDE MEDICAL, MENTAL HEALTH, OR CLINICAL ADVICE OF ANY KIND.
Arbitration: SECTION 16 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. UNLESS YOU OPT OUT WITHIN 30 DAYS, ALL DISPUTES WILL BE RESOLVED BY ARBITRATION ON AN INDIVIDUAL BASIS.
Auto-Renewal: PREMIUM SUBSCRIPTIONS RENEW AUTOMATICALLY UNLESS CANCELLED AT LEAST 24 HOURS BEFORE THE PERIOD ENDS.
Acceptance of Terms
By downloading, installing, accessing, or using MyEchoPath — including by clicking "I Accept," completing account registration, or browsing our website — you represent that: (1) you have read, understand, and agree to be bound by this Agreement; (2) you are of legal age to form a binding contract; (3) you are not barred from using the Service under applicable law; and (4) if acting on behalf of an entity, you have authority to bind that entity.
If you do not agree to this Agreement, do not access or use the Service.
This Agreement incorporates by reference our Privacy Policy and Consumer Health Privacy Policy.
Eligibility
You must be at least 13 years of age to use MyEchoPath. Users between 13 and 17 may only use the Service with verifiable parental consent. You represent that you have not been previously suspended or removed from the Service, are not creating an Account using a false identity, and that your use complies with all applicable laws. You agree not to have more than one Account at any given time.
License to Use
Subject to your compliance with this Agreement, MyEchoPath grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the MyEchoPath application on a device you own or control, solely for your own personal, non-commercial purposes.
You may not: copy, modify, distribute, sell, sublicense, reverse engineer, or decompile the Service; use it to build a competing product; access it by automated means; or use it commercially without our written consent. All rights not expressly granted are reserved by MyEchoPath.
Registration & Your Account
You agree to provide accurate, current registration information and keep it updated. You are solely responsible for all activity under your Account. Do not share your Account or password. Notify us immediately at hello@myechopath.com of any unauthorized access.
You acknowledge that you have no ownership interest in your Account — all rights in and to your Account are owned by MyEchoPath. We may suspend or terminate your Account if we have reasonable grounds to suspect your registration information is inaccurate.
Content & Journal Entries
Your Content
You — not MyEchoPath — are entirely responsible for all content you upload or record through the Service ("Your Content"). In response to your entries, the Service may generate AI-generated reflections ("Reflected Content"). Reflected Content is provided "as is" — MyEchoPath makes no warranty as to its accuracy, appropriateness, or suitability. You assume all risks associated with your use of Reflected Content.
Audio recording consent
By using the recording feature, you: (i) consent to your voice being recorded and processed as described; (ii) agree to comply with all applicable recording laws; and (iii) agree to obtain consent from any other individuals before recording them.
AI-generated content
YOU — AND NOT MYECHOPATH — ARE SOLELY RESPONSIBLE FOR YOUR USE OF AI-ENABLED FEATURES AND ANY AI-GENERATED REFLECTED CONTENT. YOU ASSUME ALL RISKS. MYECHOPATH IS NOT LIABLE FOR ANY ACTION YOU TAKE BASED ON AI-GENERATED CONTENT.
Storage
Free users retain audio for 7 days; premium users indefinitely. MyEchoPath has no liability for the deletion or loss of Your Content. Sharing entries to the Collective Echo feed is strictly opt-in — you may remove any shared entry at any time.
Ownership
MyEchoPath's intellectual property
Except for Your Content, MyEchoPath and its licensors own all rights, title, and interest in the Service — including all software, design, trademarks, and trade names. You may not use our trademarks without written permission.
Your Content ownership
You retain ownership of Your Content. You grant MyEchoPath a limited, worldwide, royalty-free license to store, process, and transmit Your Content solely to operate the Service. We will not use Your Content to train AI models unless you explicitly opt in.
Feedback
Any ideas, suggestions, or feedback you submit may be used by us freely for any purpose. Submission of Feedback creates no confidentiality obligation on our part.
AI Features & Reflected Content
MyEchoPath uses Anthropic Claude and OpenAI Whisper to power transcription, emotional analysis, and coaching prompts. By using AI features, you consent to sharing your voice transcripts with these providers as described in our Privacy Policy.
- Third-party AI providers do not train their models on your identifiable personal information
- Reflected Content is generated by AI, may not be unique across users, and is provided as-is
- You are solely responsible for any decisions or actions based on Reflected Content
- MyEchoPath accepts no responsibility for Reflected Content generated in response to your entries
AI-generated content may be inaccurate, inappropriate, or unexpected. Never rely on AI-generated insights for medical, psychiatric, or health-related decisions.
No Medical Advice
MYECHOPATH DOES NOT OFFER MEDICAL, MENTAL HEALTH, OR ANY OTHER TYPE OF HEALTH ADVICE, INCLUDING PSYCHOTHERAPY OR MENTAL HEALTH COUNSELING. THE SERVICE IS PROVIDED FOR PERSONAL REFLECTION PURPOSES ONLY AND SHOULD NOT BE CONSTRUED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, EVALUATION, OR CONSULTATION.
THE SERVICE SHOULD NOT BE RELIED UPON TO DIAGNOSE OR TREAT ANY MEDICAL OR MENTAL HEALTH CONDITION, OR DURING A MEDICAL OR PSYCHOLOGICAL EMERGENCY. YOUR USE OF THE SERVICE DOES NOT CREATE ANY PATIENT-PROVIDER OR DOCTOR-PATIENT RELATIONSHIP. CALL 911 OR YOUR DOCTOR FOR ALL MEDICAL EMERGENCIES.
Health & Safety Warning
IF YOU ARE EXPERIENCING A MENTAL HEALTH CRISIS, THOUGHTS OF SELF-HARM, SUICIDAL IDEATION, OR ANY MEDICAL EMERGENCY, STOP USING MYECHOPATH AND IMMEDIATELY CONTACT EMERGENCY SERVICES (911) OR THE 988 SUICIDE & CRISIS LIFELINE (CALL OR TEXT 988). MYECHOPATH PROVIDES NO REAL-TIME CRISIS SUPPORT.
By using the Service you expressly assume all risks associated with self-reflection and emotional journaling, including emotional triggering, distress from exploring past events, and any physical or psychological reaction.
Prohibited Conduct
You agree not to:
- Commercially exploit or sublicense the Service without our written consent
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools, scrapers, or bots to collect data from the Service
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or introduce viruses or harmful code
- Upload content that is unlawful, threatening, harassing, defamatory, or obscene
- Attempt to de-anonymize or identify other users of the Collective Echo feed
- Post a photograph of another person without their permission
- Create an Account if you have previously been suspended or removed from the Service
Violations may result in immediate Account termination and may subject you to civil or criminal liability.
Subscriptions & Billing
- Free tier: Up to 5 voice entries per week, basic emotion label, listen-only access to Collective Echo feed. Free forever, no credit card required.
- Echo Premium: Unlimited entries, full AI insights, coaching prompts, 30-day growth history, Collective Echo sharing, and lifetime audio archive. Available monthly ($4.99/month) or yearly ($34.99/year).
- Free trial: We may offer a 7-day free trial. Your subscription converts to paid automatically at trial end unless you cancel beforehand.
- Auto-renewal: YOUR SUBSCRIPTION AUTOMATICALLY RENEWS UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD. Manage and cancel in your App Store or Google Play account settings.
- Price changes: We may change prices with advance notice. Continued use after a price change constitutes agreement to the new price.
- Payment processing: All payments processed by Apple App Store or Google Play. We never collect or store your payment card details.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. MYECHOPATH DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; AND WARRANTIES REGARDING THE ACCURACY OF ANY AI-GENERATED CONTENT.
Your use of the Service is at your own risk. No advice obtained through the Service creates any warranty not expressly stated in this Agreement.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYECHOPATH AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING PHYSICAL INJURY, DEATH, PSYCHOLOGICAL HARM, EMOTIONAL DISTRESS, OR LOSS OF DATA — ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID MYECHOPATH IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00).
Indemnification
You agree to indemnify, defend, and hold harmless MyEchoPath LLC and its owners, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, and attorneys' fees arising out of:
- Your violation of this Agreement
- Your use or misuse of the Service
- Your Content, including any claim that it infringes a third party's rights
- Any physical, emotional, or psychological harm you experience from using the Service
- Your reliance on any AI-generated Reflected Content, insights, or prompts
Termination
- By you: Delete your account via Profile → Settings → Delete Account or email hello@myechopath.com. Deletion cancels your subscription going forward but does not entitle you to a refund for the current period.
- By us: We may suspend or terminate your Account at any time with or without cause, including for violation of this Agreement, harmful conduct, or legal requirements.
- Survival: Sections on Ownership, AI Features, No Medical Advice, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Arbitration survive termination.
Arbitration Agreement
THIS SECTION REQUIRES INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION. YOU HAVE 30 DAYS FROM YOUR FIRST USE OF THE SERVICE TO OPT OUT BY EMAILING legal@myechopath.com.
- Agreement to arbitrate: All disputes arising from this Agreement or the Service shall be resolved by binding individual arbitration under AAA rules, except qualifying small claims court cases.
- Class action waiver: YOU AND MYECHOPATH AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY — NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION. YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
- Informal resolution first: Contact legal@myechopath.com to attempt informal resolution before filing any arbitration claim. We will attempt resolution within 30 days.
- 30-day opt-out: Send written notice to legal@myechopath.com within 30 days of first using the Service to opt out of arbitration.
- Exceptions: Either party may seek emergency injunctive relief from a court to prevent irreparable harm pending arbitration.
Governing Law
This Agreement is governed by the laws of the United States without regard to conflict of law principles. Any dispute not subject to arbitration shall be brought in state or federal courts in [Your State]. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Changes to Terms
We may modify this Agreement at any time. Material changes will be posted with a new effective date and notified via in-app notification. Your continued use after the effective date constitutes acceptance of the modified Agreement.
